Welcome to BrushHammer Miniature Painter (“BrushHammer,” the “Game,” or the “Service”), developed and operated by Soliton Interactive Inc. (“Soliton,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of BrushHammer, including the game, related software, content, features, websites, and services.

By downloading, installing, accessing, or using BrushHammer, you agree to these Terms. If you do not agree with these Terms, please do not use the Game.

1. Eligibility

You must meet the minimum age requirements applicable to your country and the requirements established by Meta for using Meta Quest services.

If you are under the age required to enter into a binding agreement in your jurisdiction, you may only use BrushHammer with the permission and supervision of a parent or legal guardian where required by law.

You are responsible for ensuring that your use of BrushHammer complies with the laws applicable to you.

2. License to Use the Game

Subject to these Terms, Soliton grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to install and use BrushHammer on compatible devices that you own or control, solely for personal, non-commercial entertainment purposes.

You may not:

  • Copy, reproduce, redistribute, or resell the Game except as permitted by law;

  • Modify, reverse engineer, decompile, or disassemble the Game, except where such activities cannot legally be restricted;

  • Circumvent security or technical protection measures;

  • Use the Game to operate a commercial service without our written permission;

  • Extract, reproduce, or commercially exploit Game assets, models, textures, sounds, code, or other content;

  • Use automated systems, cheats, exploits, or unauthorized third-party software to interfere with the Game.

All rights not expressly granted to you remain with Soliton and its licensors.

3. Game Content

BrushHammer contains virtual miniatures, models, environments, tools, materials, paints, effects, sounds, artwork, animations, software, and other content (“Game Content”).

Game Content is owned by or licensed to Soliton and is protected by applicable intellectual property laws.

Your purchase or use of BrushHammer does not transfer ownership of the Game or Game Content to you.

We may update, modify, add, or remove Game Content and features from time to time.

4. Your Creations

BrushHammer may allow you to create, customize, paint, modify, photograph, save, or otherwise interact with virtual miniatures and other content (“Your Creations”).

You retain ownership of original creative content that you create using BrushHammer to the extent that you are legally entitled to own such content.

However, Your Creations may incorporate Game Content owned or licensed by Soliton. You do not acquire ownership of those underlying assets simply because you use them in a creation.

If BrushHammer allows you to share Your Creations with other users or through third-party platforms, you grant Soliton a non-exclusive, worldwide, royalty-free license to host, reproduce, display, transmit, and technically modify Your Creations as reasonably necessary to operate, maintain, promote, and improve the Service.

This license does not give Soliton ownership of Your original creations.

5. User-Generated Content

If BrushHammer includes features allowing you to upload, publish, share, or otherwise make content available to other users (“User Content”), you are responsible for that content.

You agree not to submit User Content that:

  • Violates applicable laws or regulations;

  • Infringes another person’s intellectual property, privacy, or other rights;

  • Contains illegal, abusive, threatening, hateful, discriminatory, or excessively violent material;

  • Contains pornography or sexually explicit material;

  • Harasses, impersonates, or targets another person;

  • Contains malware, viruses, or malicious code;

  • Attempts to scam, deceive, or exploit other users;

  • Is designed to interfere with the operation of the Game or its community.

We may remove or restrict access to User Content that violates these Terms or that we reasonably believe is harmful to the Service or its users.

6. Community and Online Features

If BrushHammer provides multiplayer, social, sharing, messaging, community, or other online features, you agree to use those features respectfully and responsibly.

You must not attempt to disrupt other users’ experience, exploit bugs or vulnerabilities, manipulate online systems, or interfere with the operation of the Service.

We may suspend or restrict access to online features for users who violate these Terms.

7. Purchases and Virtual Items

BrushHammer may offer paid content, downloadable content, cosmetic items, expansions, or other digital products.

Purchases may be processed through Meta or another authorized platform. Purchases are subject to the applicable platform’s payment, refund, and consumer policies.

Unless otherwise stated, virtual items and other digital content have no monetary value outside the Game and cannot be exchanged for real money.

We reserve the right to modify, discontinue, or replace virtual items and other digital content, subject to applicable law.

Nothing in these Terms limits any mandatory consumer rights you may have under applicable law.

8. Refunds

Purchases made through the Meta Quest Store are generally subject to Meta’s applicable refund policies and procedures.

Where applicable law gives you additional cancellation, refund, or consumer rights, those rights remain unaffected by these Terms.

9. Intellectual Property

BrushHammer, including its name, logo, software, artwork, characters, miniature models, environments, interfaces, sounds, music, trademarks, and other Game Content, is owned by or licensed to Soliton Interactive Inc.

You may not use Soliton’s trademarks, logos, or other branding without our prior written permission.

Nothing in these Terms grants you ownership of Soliton’s intellectual property.

10. Third-Party Services

BrushHammer may integrate with or rely on third-party services, including Meta Quest services, online platforms, analytics providers, cloud services, or other technologies.

Your use of those services may be subject to separate terms and privacy policies established by the relevant third parties.

Soliton is not responsible for third-party services that it does not control.

11. Updates and Changes to the Game

We may release patches, updates, improvements, new features, or changes to BrushHammer.

Some updates may be necessary to continue using the Game or certain features.

We may discontinue or modify all or part of the Service where reasonably necessary, including for technical, business, legal, or security reasons.

Where required by applicable law, we will provide appropriate notice of material changes.

12. Availability

We aim to keep BrushHammer available and functional, but we do not guarantee that the Game or any particular feature will always be available, uninterrupted, or error-free.

The Service may occasionally be unavailable because of maintenance, updates, technical issues, network problems, or circumstances beyond our reasonable control.

13. Health and Safety

BrushHammer is designed for use with virtual and mixed-reality devices.

You are responsible for following the safety instructions provided by Meta and your VR headset manufacturer.

Before playing, make sure you have sufficient physical space and remove objects or obstacles that could cause injury or damage.

Do not play while driving, walking in unsafe environments, or when doing so could put you or others at risk.

Take regular breaks and stop using the Game if you experience discomfort, dizziness, nausea, eye strain, disorientation, or other symptoms.

14. Disclaimers

To the maximum extent permitted by applicable law, BrushHammer is provided on an “as is” and “as available” basis.

We do not guarantee that the Game will always meet your expectations or that it will be completely free of bugs, interruptions, or errors.

Nothing in these Terms excludes or limits any warranty, guarantee, or consumer protection right that cannot legally be excluded or limited in your jurisdiction.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Soliton and its directors, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of BrushHammer.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law, including liability that cannot legally be excluded or limited.

16. Suspension and Termination

You may stop using BrushHammer at any time.

We may suspend or terminate your access to online features or the Service if you materially violate these Terms, engage in fraudulent or abusive behavior, or otherwise misuse the Service.

Where appropriate and reasonably possible, we may provide notice and an opportunity to correct a violation before taking action.

Termination does not affect rights or obligations that, by their nature, should continue after termination.

17. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will take reasonable steps to notify users, where required by applicable law.

Your continued use of BrushHammer after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.

18. Governing Law

These Terms are governed by the laws applicable in the Province of Quebec, Canada, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

If you are a consumer, nothing in these Terms is intended to deprive you of mandatory rights or protections provided by the laws applicable to you.
